REQUESTS FOR ANY SERVICE IS ACCEPTED EXPRESSLY ON THE CONDITION THAT, YOU (the "Client") ACCEPT THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS AND CONDITIONS, PLEASE DO NOT REQUEST SERVICES FROM "ROSE OF THE SHIRES" ("the Organisation").
The Rose of the Shires shares positive news about our county for visitors and for those who live here. We publish on this website and on Facebook and on Twitter. We are especially eager to spotlight voluntary and not-for-profit organisations, as well as businesses which build up the community.
1. FREE SERVICES
When a service is provided free of charge, the Organisation is under no obligation to meet or maintain any specified standard or to sustain the service for any minimum period. The Client accepts as a condition of acceptance by the Organisation that any text or other material offered for publication as part of a free service may be edited or omitted at the sole discretion of the Principal of the Organisation without any requirement for consultation, explanation or approval from the Client and will be maintained on line only so long as it is economically viable for the Organisation to do so.
2. PAID-FOR SERVICES
Full payment for domain name registration, the provision of web content and maintenance thereof for the agreed period must be made in advance unless alternative arrangements have been agreed in writing. Unless otherwise so confirmed, payment for new material, updates and revisions is due in advance of publication. Unless agreed in writing, all invoices must be settled on presentation (within seven days). The Client acknowledges the Organisation' right to suspend access to material on line until any overdue payment is settled.
HTML mark-up, scripts, other software and graphics created by the Organisation are © copyright and the sole property of the Principal of the Organisation. When used to support the display of content supplied by clients, that use is under license only and the intellectual property of the Organisation may not be copied or sold. Other copyright owner's rights over text and graphics supplied by or for the Client are respected and acknowledged on request. New material is not published on the Internet until paid for in full.
All material on this website is © Copyright to the respective originators. You may not reproduce anything here in any form without permission. Material on the Internet is "accessible to the public" but NOT "in the Public Domain". The Enterprise and Regulatory Reform Act 2013 requires that you contact us before claiming that any photograph on this site is "orphaned" and available for use. Check the IPO Copyright Notice. We welcome enquiries from private individuals, charities, schools and other not-for-profit organisations who would like to use our photos free of charge. We may not charge small businesses which undertake to show a link to this website. By making any other use you agree to be invoiced for permission and royalties.
4. TECHNOLOGICAL CURRENCY:
The contents of web sites and pages are provided to perform with Internet software as described in the schedule below at the time of authoring. Changes to the Client's web sites and pages to meet the requirements of other software are chargeable.
5. TECHNICAL INTEGRITY:
While every effort is made to secure text, graphics and other material supplied for inclusion in listings, and on a Client's web sites and pages, no Organisation can gurantee total protection from criminal "hacking" or equipment failure. The Client undertakes to keep a backup copy of all material supplied to the Organisation.
6. LIMITED WARRANTY AND DISCLAIMER:
The Client agrees to accept any software and scripts "AS IS" and without any guarantee that it is error-free, will operate without failure, or is compatible with any other software or any equipment. The Client agrees to accept any Service "AS IS" and without any guarantee that it will operate without interruption or to any given standard. The Organisation specifically advises against the use of any software or reliance upon the Service in any circumstances where people or property or business could be at risk and therefore will accept no liability for any kind of damage occasioned by such use, including loss of income. The Organisation does not offer any software or script as fit for any particular purpose.
7. LIMITATIONS OF LIABILITY:
In no event, except as determined by the over-riding Laws of England, will the Organisation be liable for indirect or consequential damages arising from any claim by the Client.
8. NETWORK SERVICES:
The Client agrees to be bound by any terms and conditions relating to the provision of services determined by the external providers of services to the Organisation. Details of those terms and conditions are available on request. The Client acknowledges and accepts that the provision, maintenance and reliability of Network Services provided to the Organisation by third parties are beyond the Organisation's control.
The Client undertakes never knowingly to transmit or receive, cause to be transmitted or received or allow to be transmitted or received nor ever to include in any message or material sent for inclusion in any web page or web site anything of an improper, immoral or illegal nature or anything the transmission or reception or retention of which is itself in contrary to the Laws of England, including the laws of Copyright. Any breach of that undertaking is likely to result in the suspension of all access to the Client's listings, web site or web pages and the immediate and permanent deletion of any stored e-mail and other items.

The Organisation validates new HTML to World Wide Web Consortium specifications for HTML5. Web sites and web pages are tested on the latest "generally available" release of a number of browsers. While sites should work correctly on recent earlier versions of many browsers, the Organisation does not support browsers which are not standards compliant.
